On January 1, 2006, The University of Utah filed a motion to compel the testimony and deposition of Dr. John S. Mark, a medical examiner for the State of Utah, under oath. In that motion, the University of Utah sought to compel Mr. Mark to either produce records relating to the cause of death of Jane Roe, an Arizona resident, or to take the same under oath. On December 7, 2005, Dr. Mark executed an affidavit admitting to having made no record which was based upon any statement submitted by either of the two parties to the proceedings. In his affidavit, he stated that he had received the medical records of Jane Roe on November 30, 2005, from the State of Arizona but did not have the medical records for her, or any other persons involved, regarding the actual cause of death. He stated that he had examined Jane.
